1. What is being rented

One assigned outdoor gravel parking space for one boat, RV, camper or trailer up to 40 feet in overall length, including the tongue and hitch.

This is a parking space only. No building, cover, electric, water, sewer, dump station or other utilities are provided.

2. Term

This agreement runs month to month starting on the start date listed below. It continues each month until either party ends it under section 14.

3. Rent

Rent is $85 per month, due in advance on the ____ day of each month. The first month's rent is due before move-in.

Rent is not prorated or refunded for partial months unless Owner agrees in writing. Owner may change the rent with at least 30 days' written notice.

4. Late payment

Late fee: $25

A returned or failed payment carries a fee of $____.

5. Non-payment, lockout and removal

If rent or fees remain unpaid ____ days after the due date, Owner may deny Tenant access to the vehicle until the account is paid in full.

If the account is still unpaid ____ days after the due date, Owner may, after written notice sent to Tenant's contact information on file, have the vehicle towed or removed at Tenant's expense and use any other remedy allowed by Delaware law, including any lien rights. Tenant is responsible for towing, storage and collection costs to the extent allowed by law.

6. Registration and insurance

The vehicle must be currently registered and insured for as long as it is stored here. Tenant will give Owner proof of registration and insurance at move-in, whenever either is renewed, and on request.

Owner does not insure Tenant's vehicle or property. Tenant is responsible for carrying insurance that covers theft, fire, weather and other damage while the vehicle is stored.

7. Condition of the vehicle

The vehicle must be in operable condition and able to be moved, under its own power or by Tenant's tow vehicle. It must not leak fuel, oil, coolant or any other fluid.

Owner may require Tenant to remove a leaking or inoperable vehicle. Tenant will pay the cost of cleaning up any leak or spill.

8. Storage only

The space is for storage only. No living, sleeping or overnight stays on the property.

No mechanical work, repairs, washing, detailing or fluid changes on the property. No dumping of holding tanks, trash or other materials.

9. No hazardous materials

Tenant will not store hazardous, flammable, toxic or explosive materials, including spare fuel cans or extra propane cylinders. Built-in fuel and propane tanks must be closed and shut off while stored.

10. Access and entry

The lot is on private property. Access: During daylight hours only

Owner controls the gate and entry. Tenant will not share any gate code, key or access with anyone else, and will not bring other people onto the property without Owner's permission. Tenant will drive slowly and stay on the driveway and the lot.

11. Assigned space, no subletting

Tenant will use only the space Owner assigns. Tenant may not sublet, assign or transfer this agreement, or let anyone else store anything in the space.

12. Stored at Tenant's own risk

The vehicle and everything in it are stored entirely at Tenant's own risk. Owner living on site and cameras on the property are not a guarantee of security.

To the fullest extent allowed by law, Owner is not responsible for loss of or damage to the vehicle or its contents from theft, vandalism, fire, weather, flood, falling trees, animals or any other cause, except to the extent caused by Owner's gross negligence or willful misconduct. Tenant should remove valuables.

13. Tenant liability and indemnity

Tenant is responsible for any damage or injury caused by Tenant, Tenant's guests or Tenant's vehicle to the property, to Owner or to others.

Tenant agrees to indemnify, defend and hold Owner harmless from any claims, costs and expenses, including reasonable attorney fees, that arise from Tenant's vehicle, Tenant's use of the property, or the acts of Tenant or Tenant's guests.

14. Ending the agreement

Either party may end this agreement with at least ____ days' written notice. Text message or email to the contact information on file counts as written notice.

By the end date, Tenant will remove the vehicle and all belongings and leave the space clean. A vehicle left more than ____ days after the end date may be treated as abandoned and removed at Tenant's expense as allowed by Delaware law.

15. Contact information

Tenant will keep a current phone number, email and mailing address on file with Owner. Notices are properly given when sent to that contact information.

16. General

This agreement and any written lot rules Owner gives Tenant are the entire agreement. Changes must be in writing. Delaware law applies. If any part is found unenforceable, the rest still applies.

17. Electronic records and signature

Tenant agrees that this agreement may be signed and kept electronically, and that Tenant's typed name is Tenant's legal signature with the same effect as a handwritten one. Tenant may ask Owner for a paper copy at no charge.
